Citizenship loss provisions
The Attorney-General the Hon Christian Porter MP, referred for my review the operation, effectiveness and implications of the terrorism-related citizenship loss provisions in the Australian Citizenship Act 2007, to be reported on by 15 August 2019.
The referral concerns sections 33AA (‘renunciation by conduct’), 35 (‘service outside Australia in armed forces of an enemy country or a declared terrorist organisation’) 35A (‘conviction for terrorism offences and certain other offences’) and 35AA (‘declared terrorism organisation’) of the Australian Citizenship Act 2007.
In conducting this review, I received submissions and held private and public hearings and consulted with ministers, judges, human rights bodies, legal experts and organisations.
The Parliamentary Joint Committee on Intelligence and Security is to undertake and report on its own review of these provisions by 1 December 2019. The INSLM report is available to assist the work of the PJCIS.
A public hearing associated with the review was held in Canberra on 27 June 2019.
